This user agreement (“Agreement”) is an agreement between you and Bansal Information and Technology LLC (“Company”, “we”, “us”, or “our”) governing your use of the Company’s products, software and/or services (collectively referred to as “Services”) offered by AppoFit and your use of the marketplace made available on the Website and the App (“Marketplace”) (collectively referred to as the “Platform”).

Welcome to AppoFit, a platform developed by Bansal Information and Technology LLC (“we,” “us,” or “Company”). These Terms of Service (“Terms”) explain how you can use our website (AppoFit.com) and mobile app (together, the “Platform”).

Acceptance

By accessing or using the Platform, you agree to comply with and be bound by these Terms.

Who Can Use AppoFit

AppoFit is designed for personal trainers, wellness coaches, and nutritionists (“Trainers”) to manage
their clients (“Clients”) and run their business, and for Clients to connect with Trainers and track
their progress. Trainers and Clients are collectively referred to as “Users.”

What the Platform Does

• Provides Clients with access to a digital platform including a branded mobile application, website, CRM, dashboard, hosting, payment integrations, and support.
• Helps Trainers manage Clients and create workout plans, meal plans, recipes, and exercise routines.
• Allows Trainers to track Client progress and upload files, videos, or other materials.
• Allows Clients to interact with Trainers and monitor their fitness, diet, and wellness progress.

Using the Platform

By using AppoFit, you agree to follow these Terms, our Privacy Policy, and any additional policies referenced.

Eligibility

• You must be at least 18 years old to register as a user.
• If you are under 18, you may use the Services only under parental or guardian supervision.

Basic Terms

• You may not post content that is violent, nude, discriminatory, unlawful, hateful, pornographic, or sexually suggestive.
• You are responsible for all activity through your account.
• You may not sell, transfer, or assign your account.
• You must provide accurate and current information.
• You must not access other users’ login credentials.
• You must keep your password secure.
• You must not harass, threaten, or impersonate other users.
• You must not post confidential or personal information of others.
• You must comply with all applicable laws.
• You must not modify the AppoFit platform to falsely suggest association with AppoFit.
• You must not access private APIs without permission.
• You must not send spam or unwanted commercial messages.
• You must not transmit viruses, malware, or harmful code.
• You must not create accounts using automated tools or bots.
• You must not interfere with other users’ ability to use the Platform.

Changes to the Terms

We may update these Terms from time to time. Changes take effect once posted on the Platform. Continued use of the Platform means you accept the updated Terms.

Agreement Between Trainer and Client

AppoFit only provides the platform to connect Trainers and Clients. Any agreement between Trainers and Clients (“Trainer-Client Agreement”) is a direct contract between them.

• AppoFit is not a party to the Trainer-Client Agreement.
• No employment, partnership, or joint venture relationship is created.
• Clients purchase services directly from Trainers.
• AppoFit is not responsible for disputes between Trainers and Clients.

Trainer Responsibilities

• Provide services to clients satisfactorily.
• Ensure proper qualifications or licenses where required.
• Handle agreements with clients.
• Pay applicable taxes and fees.

Medical Advice Disclaimer

The Platform does not provide medical advice. Always consult a physician before beginning a fitness, nutrition, or health program.

• You voluntarily participate in fitness programs.
• You assume all associated risks.
• You confirm you are physically capable of participating.

Fees and Payments

• Access to the Platform may require service fees.
• Fees are charged in INR and are generally annual.
• Subscription fees are usually non-refundable.
• Services may be paused if payment is delayed beyond 30 days.

Payments

• Payments may be made via credit/debit cards or other processors.
• Payment processors handle transaction data.
• AppoFit does not store card details.

Refund & Cancellation Policy

• No Refunds: Subscription payments are non-refundable.
• Cancel Anytime: Access continues until the end of the paid period.

Account Security

• Keep your login credentials confidential.
• Notify us immediately of unauthorized access.
• Always log out on shared devices.

Intellectual Property Rights

All content, design, graphics, and code related to the Platform are owned by AppoFit or its licensors. Unauthorized copying, distribution, or modification is prohibited.

User Contributions

Users may post content on the Platform (“User Contributions”). By posting content you grant AppoFit a license to use, reproduce, modify, and distribute that content in connection with the Platform.

Monitoring and Enforcement

AppoFit reserves the right to:

• Remove content that violates these Terms.
• Take legal action for unauthorized use.
• Suspend or terminate accounts.
• Cooperate with law enforcement when required.

Content Standards

User contributions must not:

• Contain abusive or offensive content
• Promote illegal activity
• Infringe intellectual property rights
• Mislead or impersonate others

Third-Party Links

The Platform may contain links to third-party websites. AppoFit is not responsible for the content or services of these websites.

Geographic Restrictions

The Platform is operated from Bhopal, India. Users accessing it from other locations are responsible for complying with local laws.

Disclaimer of Warranties

The Platform and its services are provided “as is” and “as available” without warranties of any kind.

Limitation of Liability

AppoFit’s liability will not exceed the amount paid by you in the last six (6) months for the service related to the claim.

Indemnification

You agree to defend and indemnify AppoFit against any claims arising from your use of the Platform or violation of these Terms.

Governing Law

These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of courts in Bhopal.

Arbitration

Disputes may be resolved through binding arbitration under Indian arbitration rules.

Limitation on Time to File Claims

Any claim must be filed within one (1) year after the cause of action arises.

No Class Actions

Claims may only be brought individually and not as part of a class action.

Waiver and Severability

If any provision is found invalid, the remaining provisions remain enforceable.

Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and AppoFit.

Assignment

You may not assign your rights under these Terms without written consent. AppoFit may assign them at any time.
